En Ecuador, la gestación por sustitución enfrenta desafíos jurídicos importantes por la falta de regulación específica, lo que genera incertidumbre legal para los niños nacidos, las madres gestantes y los comitentes. Este artículo tiene como objetivo describir los vacíos legales en torno a la maternidad subrogada, lo cual demanda de un marco regulatorio que proteja a todos los involucrados. Se utilizó un método exegético jurídico y un análisis comparado de regulaciones internacionales siguiendo como metodología la revisión bibliográfica. Los resultados muestran la vulneración del derecho a la identidad de los niños y problemas de custodia y paternidad, así como la dignidad de las madres gestantes, quienes pueden enfrentar maternidad no deseada. Los comitentes enfrentan inseguridad jurídica al no poder inscribir a los niños en el Registro Civil. El estudio concluye que es necesario establecer regulaciones específicas que eliminen esta inseguridad y respeten la voluntad procreacional de las partes implicadas.
In Ecuador, gestational surrogacy faces significant legal challenges due to the absence of specific regulation, creating legal uncertainty for the children born, the gestational mothers, and the intended parents. This article aims to describe the legal gaps surrounding surrogacy, highlighting the need for a regulatory framework that protects all parties involved. An exegetical legal method and a comparative analysis of international regulations were employed, using a bibliographic review as the methodology. The results show violations of children's right to identity, issues of custody and paternity, as well as the dignity of gestational mothers, who may face unwanted motherhood. Intended parents experience legal insecurity, as they are unable to register the children in the Civil Registry. The study concludes that it is necessary to establish specific regulations that eliminate this insecurity and respect the reproductive intentions of the parties involved.
