Las garantías jurisdiccionales y la protección de los derechos de la niñez en Ecuador: análisis del caso de maltrato infantil en Portoviejo

El objetivo del estudio fue analizar la efectividad de las garantías jurisdiccionales en la protección de los derechos de la niñez en Ecuador. Se aplicó un enfoque cualitativo con diseño de estudio de casos, mediante análisis documental de fuentes normativas, jurisprudenciales y académicas. La muestra fue seleccionada de forma intencional, conformada por diez casos relevantes para el estudio del maltrato infantil en Ecuador. Los resultados indicaron que las garantías jurisdiccionales ofrecen mecanismos ágiles y accesibles, alineados con estándares internacionales. Entre las principales limitaciones se identificaron la insuficiente capacitación de operadores judiciales, la sobrecarga procesal y la falta de articulación interinstitucional, lo que afecta su eficacia en contextos como la violencia intrafamiliar y el acceso a la justicia para grupos vulnerables. Se concluye que, aunque el marco normativo ecuatoriano es progresista, la implementación práctica de las garantías jurisdiccionales requiere mejoras sustanciales. Se recomienda fortalecer la especialización judicial, optimizar los procesos administrativos y promover la articulación interinstitucional para garantizar una protección integral y efectiva de los derechos de la niñez.
The objective of this study was to analyze the effectiveness of jurisdictional guarantees in protecting children's rights in Ecuador. A qualitative approach was applied, using a case study design through documentary analysis of normative, jurisprudential, and academic sources. The sample was intentionally selected, consisting of ten cases relevant to the study of child abuse in Ecuador. The results indicated that jurisdictional guarantees provide agile and accessible mechanisms aligned with international standards. The main limitations identified include insufficient training of judicial operators, procedural overload, and lack of inter-institutional coordination, which affect their effectiveness in contexts such as domestic violence and access to justice for vulnerable groups. It is concluded that, although Ecuador's regulatory framework is progressive, the practical implementation of jurisdictional guarantees requires substantial improvements. It is recommended to strengthen judicial specialization, optimize administrative processes, and promote inter-institutional coordination to ensure comprehensive and effective protection of children's rights.
