Análisis, desafíos y aplicación de la justicia restaurativa en los juicios de tránsito en Ecuador

En el segundo trimestre de 2024 se registraron 5.413 siniestros de tránsito, un aumento del 8,37 % respecto al mismo periodo del año anterior (INEC). La reincidencia de algunos conductores refleja una falta de conciencia y empatía hacia las víctimas. En 2019, el Código Orgánico Integral Penal incorporó la Justicia Restaurativa, orientada a resolver conflictos mediante la reparación del daño, aceptación del error y participación comunitaria. Sin embargo, su aplicación en delitos de tránsito es limitada debido al desconocimiento de víctimas y abogados sobre el derecho a solicitar audiencias de este tipo, así como a la falta de obligatoriedad para el sentenciado. El objetivo de esta investigación fue analizar la aplicación de la justicia restaurativa en estos casos. Se revisaron leyes, doctrinas e interpretaciones bajo un enfoque cualitativo, utilizando métodos como el deductivo, histórico y analítico. Se concluye que no se aplica actualmente, proponiéndose reformar el artículo 651.6.num.3 del COIP.

In the second quarter of 2024, 5,413 traffic accidents were recorded, an 8.37% increase compared to the same period the previous year (INEC). The repeat offenses of some drivers reflect a lack of awareness and empathy toward victims. In 2019, the Comprehensive Organic Criminal Code incorporated Restorative Justice, aimed at resolving conflicts through reparation of damages, acceptance of errors, and community participation. However, its application in traffic offenses is limited due to the lack of awareness among victims and lawyers about the right to request such hearings, as well as the lack of binding force on the convicted person. The objective of this research was to analyze the application of restorative justice in these cases. Laws, doctrines, and interpretations were reviewed using a qualitative approach, using methods such as deductive, historical, and analytical. It is concluded that it is not currently applied, and a reform of Article 651.6 of the COIP is proposed.
